Terms of Service
Part A covers using this website. Part B covers our services. A signed proposal or project agreement can add to these terms, and where it conflicts with them, the signed document wins.

Part A. Using this website
This website is operated by Digihub Software Company (SMC-Private) Limited ("Digihub", "we"). Its content is general information, not professional advice for your situation. Prices on the pricing pages are offers for the scope described there; the scope, price and timeline of a project are fixed only in a written proposal or agreement.
Text, design, graphics and code on this website belong to Digihub unless stated otherwise. Odoo, Shopify, WordPress, Google and other names are trademarks of their owners, used only to describe the services we provide; we don't claim any partnership with them unless we say so explicitly.
We aren't responsible for external websites we link to. Don't misuse this website: no attempts to break in, overload it, or send spam through the contact form.
Part B. Our services
Our services are for businesses and other organisations, not consumers. By ordering, you confirm you are acting for a business.
B1. How a contract is made
A contract starts when you accept our written proposal (by signature or email) and pay the advance invoice. The proposal sets out the scope, deliverables, timeline and price. If a package from our pricing pages is ordered, the package description forms the scope.
B2. Scope and changes
We deliver what the proposal describes. Anything outside it is a change request: we quote it in writing, as a fixed price or at our hourly rate, and do it only after you approve the quote. Revision rounds included in a package are listed in its description.
B3. Your part
You provide content, access, decisions and feedback on time. If a delay on your side holds up the work, the timeline moves by at least the same amount. If a project is on hold waiting for you for more than 30 days, we may close the current stage and invoice the work completed so far.
B4. Payment
Payment follows the schedule in the proposal and in our Payment, Cancellation and Refund Policy. In short:
- Projects: an advance to book the work, milestone payments before each later stage starts, and the final payment before go-live.
- Monthly services: invoiced at the start of each month, in advance.
- Invoices are due within 7 days. Prices exclude taxes and third-party costs.
- If an invoice is overdue, we may pause work, and launch or handover waits until it's paid.
B5. Review and acceptance
Each milestone is delivered on a staging site for you to review. You have 7 working days to report anything that doesn't match the agreed scope. If you report nothing in that time, or start using the work for real business, the milestone is treated as accepted.
B6. Ownership of the work
When everything owed under the project has been paid, ownership of the custom code, designs and content we created specifically for you transfers to you, and we hand over the source code, credentials and documentation. Until then, the work stays ours, and you may use staging versions only to review them.
We keep ownership of our general tools, libraries and know-how, and give you a permanent, royalty-free licence to use any of them included in your project. Third-party and open-source components (for example Odoo, WordPress, plugins and themes) stay under their own licences. We may mention the project in our portfolio unless you ask us not to.
B7. Warranty
For 30 days after go-live, we fix free of charge any defect where the work doesn't do what the agreed scope says. This doesn't cover changes made by you or anyone else, third-party services, hosting, or new features. After 30 days, support is available through a care plan or at the hourly rate.
B8. Confidentiality and data
Each side keeps the other's confidential information private and uses it only for the project. Where we process personal data on your behalf (for example customer records in a system we build), we do so only on your instructions and with appropriate security; a separate data processing agreement can be signed on request.
B9. Liability
Our total liability under a project is limited to the fees you paid us for that project (or, for monthly services, the fees paid in the 3 months before the claim). We aren't liable for indirect or consequential loss, lost profits, lost data where backups weren't kept, or losses caused by third-party services. Nothing in these terms limits liability that the law doesn't allow to be limited, such as for fraud.
B10. Ending a contract
Either side may end a contract if the other materially breaches it and doesn't fix the breach within 14 days of written notice. You may cancel a project at any time; what you pay is set out in our Payment, Cancellation and Refund Policy. Monthly services can be cancelled with 30 days' notice after any minimum term.
B11. Events outside our control
Neither side is responsible for delays caused by events beyond reasonable control, such as natural disasters, internet or power outages, or government action. Timelines move accordingly.
B12. Law and disputes
These terms are governed by the laws of Pakistan, and the courts of Peshawar have jurisdiction, unless a signed project agreement chooses a different law, court or arbitration. Before any formal step, both sides will try in good faith to settle a dispute by discussion within 30 days.
